Smoking Bans Limit Your Right to Smoke Cigars

By Gary Manelski, About.com

Reason For

Inhaling second hand smoke can cause cancer in nonsmokers. In some indoor areas, such as the workplace, a nonsmoker cannot simply avoid inhaling second hand smoke. In other places, such as bars and restaurants, smoke can also be inhaled if the establishment does not take effective measures to segregate smokers, utilize adequate ventilation systems, etc. The free market system did not work in the past, as many establishments did not provide nonsmoking sections until after some regulations were adopted.

Arguments Against

While limited or partial smoking bans have been generally acceptable to both smokers and nonsmokers, comprehensive and overly restrictive smoking bans are now infringing on the constitutional rights of smokers to enjoy their freedom. Bars and restaurants, as well as other public businesses, must incur additional costs to accommodate their smoking customers, or lose their patronage. Many of the restrictions, such as smoking in outdoor parks or indoor cigar bars (established specifically for cigar smokers), will not reduce the rate of cancer in nonsmokers, but merely restrict one particular behavior that may be annoying to some people.

Outcome

So where will this all end? If the trend continues, it will only be a matter of time before smoking in public is banned everywhere, both indoors and outside. Tobacco sales will still be legal, but a personal residence may be the only place left to legally consume the products.
